LAVA Zone ("Lava") provides various features subject to the following conditions:
By entering into Lava Zone, you agree to be bound by these terms, which shall take effect immediately on your first use of Lava Zone. If you do not agree to be bound by all of the following terms please do not access, use and/or contribute to Lava Zone.
Lava may change these terms from time to time at sole discretion of Lava and you should be aware of it at all the time. Your use of Lava Zone will be treated as your deemed acceptance of the terms. If you do not agree to any of the term or the changes made thereto, you should cease using this WAP site.
When using any current or future Lava Zone service or business (e.g., Your Profile, Gift Cards, Inbox, Songs, Videos, Wallpaper or Your Media Library) you shall also adhere to the guidelines, terms and agreements ("Terms") applicable to such service or business in addition to the terms of Lava as mentioned above.

Lava is the owner of Wireless Access Protocol Site http://180.179.195.97/lava/ ,access and use of this Wireless Access Protocol Site is provided subject to the following terms and conditions.
User agrees that:
the communication is electronically transmitted and hence any agreement, notice, disclosure and other communications that are provided to you electronically, satisfy any legal requirement that such communications be in writing.
the continuance of Service will constitute user's binding acceptance of all the terms and conditions of Lava.
The terms and conditions are subject to renew and user shall update of the same.
Area of our services are expanding, hence all new services are covered under the terms and conditions of Lava at all the times.
To access the Service user may be required to subscribe for the mobile telecommunication services of the mobile operator who provides this service or with whom Lava has tied up. User shall be solely responsible for the payment of any service/subscription fees to user's mobile operator for accessing the services. The functioning and operation of the Service is dependent on the Telecom Operators network for which Lava shall not be responsible in the event of failure of Telecom Operators network transmission or failure of message transmission for any reasons whatsoever.
Lava is not responsible for technical failure of any electronic communication sent via GPRS. Lava will not be liable for any technical failure, if the user has not received or read or accepted an electronic communication.
User to provide true, accurate, current and complete information about him as prompted by the Service registration process (such information being the "Registration Data"). User shall receive a unique password in connection with user's account (collectively referred to herein as "IDs"). User shall be responsible for maintaining the confidentiality of User account and password and for restricting access by any other person.

Services

The ability to upload content to Lava via user's mobile phone (Mobile Uploads),
The ability to receive and reply to Lava messages, to send a shoot out and receive shoot outs and to write scribbles using text messaging (Mobile Texts),
The ability to access certain Lava features through a mobile application User has downloaded and installed on user'smobile phone (Mobile Client) (collectively the "Mobile Services").
User's carrier's normal messaging, VAS Messaging, VAS Download rates, data access/usage charges and other rates and fees will be charged by the Mobile Telecom Operators. Therefore, User should check with user'scarrier to find out if the Mobile Services are available for user'smobile devices, and what restrictions, if any, may be applicable to user'suse of such Mobile Services. By using the Mobile Services, User agree that we may communicate with the Users regarding Lava and other entities by SMS, MMS, text message or other electronic means to user'smobile device and that certain information about user'susage of the Mobile Services may be communicated to us. In the event User change or deactivate user'smobile telephone number, User agrees to promptly update user'sLava account information to ensure that user'smessages are not sent to the person that acquires user'sprevious number. Lava shall not be responsible in the event of failure of this network transmission or failure of message transmission for any reasons whatsoever.

Trademarks
|
Lava is the sole owner of Lava logo. Any unauthorized usage thereof shall be violative of the copyright and trademark laws.
Users hereby confirm, undertake and agree that:
Users are 18 years of age or above.
Users are solely responsible for all activities that occur under user's password or user's name.
Lava may terminate user'suse of the Site and/or the Services at any time if User breach any of these terms of use or our general terms of use or at our sole discretion if we have reason to believe that User of the Service is causing prejudice to Lava or to the other users.
Users shall comply with laws as applicable from time to time regarding the usage of Lava site; obey any codes of conduct or other notices that are provided; keep user'sservice account password secret; and promptly notify Mobile Service company if you learn of a security breach related to the service.
Lava disclaims all warranties, express or implied, in connection with the mobile service and its use thereof.
User being the original owner of the mobile device undertake to indemnify and hold harmless Lava from and against any /all claims, in consequence of your actions while using service of Lava or any part thereof.
User agrees to waive their rights with reference to the "Do Not Call Registry" so as to enable us to render our services.
User shall adhere to the terms and conditions of mobile service provider while accessing Lava services.

Term, Fees, Payments, Pricing
|
The List Price is a comparative price estimate and may or may not represent the prevailing price in every area on any particular day. With respect to items sold by Lava, Lava cannot confirm the price of a content until the User order; Lava do charge user'scredit card once link to download the content is displayed / made available on the site and / or listed to User order history on Lava. Despite the best efforts, a small number of the content in the catalog may be mispriced. If a content's correct price is higher than our stated price, we will, at our discretion, either contact you and notify you about the order cancellation.
By registering for the Service, you agree to pay the fees designated for the Service or content you select in accordance with our Pricing and Payment Terms, You agree to pay the applicable amounts for the minimum period specified therein. Your subscription will continue automatically at the fee rate applicable to the Service, which you have selected unless terminated by Lava or until you notify Lava of your decision to cancel your subscription to the Service. Upon the expiration of the initial period if any, your subscription will automatically renew on a month-to-month basis at the same monthly rate, as applicable, unless you elect to terminate the Service or enroll in another version of the Service.
Payment must be made by a major credit card accepted by Lava (currently, VISA, MasterCard, American Express and Discover), or any other methods of payment as Lava may accept from time to time. Your credit card will be billed monthly in advance commencing on your initial expiration date and continuing thereafter on a monthly basis on the thirtieth (30th) day following the expiration of the preceding billing period ("Billing Date"). If Lava does not receive payment from the credit card issuer or its agent, you agree to pay all amounts due upon demand by Lava. Your card issuer agreement governs your use of your designated card in connection with the Service, and you must refer to that agreement and not this Agreement to determine your rights and liabilities as a cardholder. YOU, AND NOT Lava, ARE RESPONSIBLE FOR PAYING ANY AMOUNTS BILLED TO YOUR CREDIT CARD BY A THIRD PARTY, WHICH WERE NOT AUTHORIZED BY YOU.
If Lava does not receive the full amount of your Service in advance commencing on you initial service expiration date, the service will be disabled without any notice. You will have to subscribe again to enable the service. Unless you notify Lava of any discrepancies within forty-five (45) days after they first appear on your account statement, they will be deemed accepted by you for all purposes, including resolution of inquiries made by your card issuer. You release Lava from all liabilities and claim of loss resulting from any error or discrepancy that is not reported to Lava within forty-five (45) days of its first appearance on an invoice or credit card statement.
You agree to pay Lava all reasonable attorney's fees and costs incurred by Lava to collect any past due amounts. Your account may be deactivated without further notice if payment is not received on initial expiration date, regardless of the value / amount payable for the service in respective currency..

The fees, charges and payments hereunder do not include and you are solely responsible for paying any taxes, duties, government levies or other charges imposed by a taxing or other regulatory authority relating to your use of the service. You are solely responsible for arranging payment for any and all additional or premium charges for your use of any third party services via the service.
Lava reserves the right, at any time, to change its fees and billing methods, including the addition of supplemental fees or separate charges for content, or services provided by Lava, Lava may additionally provide notice of billing changes. If any such change is unacceptable to you, you may cancel your subscription to the service. Your continued use of the service following the effective date of a change to such fees and billing methods shall constitute your acceptance of such change.

Intellectual Property Rights

Only the User may access the Service by using IDs, unless otherwise agreed to in writing by Lava. The content available through the Service is the property of Lava or its licensors and is protected by copyright and other intellectual property laws. Content received through the Service may be viewed, used and played for your personal, non-commercial use only. Users agree not to reproduce, retransmit, distribute, disseminate, sell, broadcast, perform, make available to third parties or circulate the content received through the Service to anyone or to exploit any such content for commercial or noncommercial purposes without the express prior written consent of Lava.
The content provided by Lava, including without limitation, the text, software, scripts, graphics, photos, sounds, music, videos, interactive features and the like ("Content") and the trademarks, service marks and logos contained therein ("Marks"), are owned by or licensed to Lava, subject to copyright and other intellectual property rights under Indian laws and conventions.
